Pixsie Studio Terms of Service

These Pixsie Studio Terms ("Studio Terms") are a legal agreement between you and Heterodox LLC ("Pixsie," "we," "us," or "our") and govern your use of Pixsie Studio at studio.pixsie.app, including client galleries you deliver through it.
Pixsie Studio is a separate, subscription-based product from the guest-upload service at pixsie.app. Our [Terms of Service] govern that product and continue to apply to anything not addressed here. Where the two conflict in relation to Pixsie Studio, these Studio Terms control.
By creating a studio, subscribing to a paid plan, or uploading Content to a Collection, you agree to these Studio Terms. If you do not agree, do not use Pixsie Studio.
1. Definitions
- Photographer means you, the professional user who creates a Studio and delivers galleries to your own customers.
- Studio means your account on Pixsie Studio, including your branding, settings, and Collections.
- Collection or Gallery means a set of Content you upload and deliver to a Client.
- Client means a person you invite to view, favorite, comment on, or download a Collection. Clients are your customers, not ours.
- Content means photographs, video, and other material you upload to Pixsie Studio.
- Plan means the subscription tier you select, together with its stated storage allowance.
2. Eligibility and accounts
You must be at least 18 years old and using Pixsie Studio in the course of a business or professional activity. You are responsible for keeping access to your sign-in email secure, because sign-in is by emailed link and control of that mailbox is control of your Studio. Notify us promptly at [hello@pixsie.app] if you believe your Studio has been compromised.
One Studio is provided per account.
3. Subscription, billing, and renewal
Plans and billing period. Pixsie Studio is offered on a free plan and on paid Plans billed either monthly or annually. The price and storage allowance of each Plan are shown at the time of purchase and on our pricing page.
Automatic renewal. Paid Plans renew automatically at the end of each billing period, at the then-current price for your Plan, until cancelled. By subscribing you authorise us and our payment processor to charge your payment method on each renewal.
Payment processing. Payments are processed by Stripe. You agree to Stripe's terms when you pay. We do not store your card details.
Taxes. Prices are stated in [USD] and are exclusive of any sales, use, VAT, GST, or similar taxes, which are your responsibility where applicable.
Failed payment. If a renewal payment fails, we may retry it and may suspend paid features until payment succeeds. See section 6 for what happens to your Content during a lapse.
Price changes. We may change Plan prices. We will give you at least [30] days' notice before a change takes effect for your Studio, and the change will apply from your next renewal after that notice. If you do not accept a price change, you may cancel before it takes effect.
4. Cancellation and refunds
Cancelling. You may cancel at any time from your billing settings, without contacting us. Cancellation takes effect at the end of the billing period you have already paid for. You keep access to your paid Plan until then.
Refunds. Paid Plans are generally non-refundable, including for partial periods, because storage and delivery capacity are provisioned for you throughout the period. If Pixsie Studio fails to function materially as described, contact us at [hello@pixsie.app] within [14] days and we will review your situation and, at our discretion, provide a credit or refund. Nothing in this section limits rights you may have under mandatory consumer protection laws.
Annual Plans. An annual Plan is a commitment for the full year and is not refunded in part on cancellation, except as set out above.
5. Storage allowances
Each Plan includes a stated storage allowance, measured against the original files you upload. Derivative files we generate for you, such as display copies, thumbnails, and watermarked versions, do not count against your allowance.
If you reach your allowance, further uploads are blocked until you remove Content or move to a Plan with a larger allowance. We do not delete your existing Content because you reached your allowance.
We may apply reasonable fair-use limits where usage is materially inconsistent with delivering client galleries, such as use as general file storage or backup. We will contact you before taking any action.
6. What happens to your Content if you cancel or lapse
This section is important, so it is stated plainly.
- While your Plan is active, your Collections stay online and your Clients can reach them.
- If you cancel, your Collections remain accessible until the end of the period you paid for.
- After a paid Plan ends or lapses, your Studio reverts to the free plan and its allowance. Content above that allowance may become unavailable to Clients. We will give you at least [30] days' notice before any Content is deleted for this reason.
- You can export your Content at any time, including on the free plan, and we will not withhold your Content as a means of collecting payment.
You are responsible for keeping your own copies of your Content. Pixsie Studio is a delivery tool, not a backup service, and should not be your only copy of client work.
7. Your Content and your Clients
You own your Content. We claim no ownership of the photographs or video you upload. You grant us a limited licence to host, process, resize, watermark, transmit, and display your Content solely to operate Pixsie Studio for you, including delivering galleries to Clients you invite.
You are responsible for your Clients. Your Clients are your customers. You are responsible for having the rights and permissions you need to upload and deliver Content depicting them, and for the agreements you have with them.
Client personal information. When your Clients open a gallery, we may collect their email address and record their favorites, comments, and access activity, so that you can see who has engaged with a Collection. In relation to that information you are the controller and we act as your processor, processing it on your documented instructions to provide Pixsie Studio to you. You are responsible for giving your Clients any notice and obtaining any consent that applicable law requires. Our [Privacy Policy] describes what we collect and how it is handled.
Deletion requests. If a Client asks you to remove their Content or their personal information, you can delete a Collection or a Client's comments yourself. Contact us at [hello@pixsie.app] if you need help completing a request.
8. Branding and custom domains
Paid Plans allow you to present galleries under your own name, branding, and, where included in your Plan, your own domain. You are responsible for the domain you connect and for the rights to any logo or mark you upload. We may display a modest Pixsie attribution on galleries delivered on the free plan.
Email we send to your Clients on your behalf carries your display name and reply address. The sending address remains ours, so that message delivery stays reliable across all studios.
9. Print sales and paid downloads
Features that would take payment from your Clients, including print sales and paid gallery downloads, are not available at this time. When they become available, they will be governed by additional terms covering payouts, fulfilment, and applicable taxes, which we will present to you before you enable them.
10. Acceptable use
You may not use Pixsie Studio to store or deliver unlawful material, material you do not have the rights to, or material that infringes another person's rights. You may not attempt to circumvent storage allowances, access another Studio's Content, or use Pixsie Studio to send unsolicited bulk email. We may suspend a Studio that does, and section 7 of our [Terms of Service] applies in full.
11. Service availability and changes
We aim to keep Pixsie Studio available but do not guarantee uninterrupted service, and we do not offer a service level agreement on any Plan. We may add, change, or remove features. If we make a change that materially reduces a feature central to your Plan, we will give you reasonable notice and you may cancel.
12. Suspension and termination
You may stop using Pixsie Studio at any time. We may suspend or terminate a Studio that breaches these Studio Terms, that is used unlawfully, or where required by law. Except in cases of serious or unlawful misuse, we will give you notice and a reasonable opportunity to export your Content first.
13. Disclaimers, liability, and disputes
Sections 12 through 18 of our [Terms of Service], covering disclaimers, limitation of liability, indemnification, governing law, dispute resolution, and general provisions, apply to Pixsie Studio and are incorporated here by reference.
14. Changes to these Studio Terms
We may update these Studio Terms. When we make material changes we will update the date above and give notice to the email on your account. Your continued use of Pixsie Studio after an update means you accept the revised Studio Terms.
